DMCA is not the only law on the books. Check out the FTC and look up unfair trade and unfair competition.
Another thing - just because the DMCA requires you to submit a take-down request, you can still sue. Nothing in the DMCA says you can't.Comment

Yes, you're right. Nobody is arguing those points. Unfortunately the tubes you are referencing don't do those things. Users upload the content. Copyright holders send a DMCA. Tube site removes copyrighted material. Tube site is legal.
Whether or not the users actually upload the content or not is another discussion, but until someone can prove it's the site themselves doing it they comply with the law. So referring to them as illegal is completely false.Comment

Legal yes, until that loophole is plugged, no loophole can be plugged to make YouTube illegal. Google is to big of a company and has to many eyes watching them to do anything like that.
Small guys yes, it takes some time, but if you're NBC/ABC/CBS/Fox etc... It will be down faster than it was uploaded.Comment

They are not considered parody because they are not original works, I do not want to argue this because its a legal discussion, but fansubs are removed from youtube and the internet everyday because of DMCAs/Cnds/whatever method.
