i don't think max hardcore is being "rightfully punished" - nor do i have any particular dislike for him. i don't think about him at all. he's just one more idiotic fuck in a cesspool of idiotic, anti-social, dysfunctional "fuck the world" idiots, which this business is full of. i considered going to his trial since i live in downtown tampa out of morbid curiosity but felt i had better things to do. in fact, i think we just forgot about it.
My position is not what a person "deserves" in this case since "deserves" is obviously a VERY subjective notion. To me, its the very simple pragmatic issue that when you are the one pushing the boundaries in the most extreme and in your face "fuck you if you don't like it" manner... you are the one that's going to be attacked. and you are going to be attacked until you are locked up. its that simple. there are no surprises here. there is no epic first amendment/free speech argument. there is just a guy peddling what almost ANY community in the USA would deem "obscene" - and mailing on top of everything else, is retarded. Then coming to a public forum to take the chance to shout "fuck the FBI..." well... i view this all as indefensible behavior and not a great shocker that he's now sitting in a jail cell.

Of course, in a backwards way, we need people like him as a lightening rod. We need a deeply disturbed person to do deeply disturbing things so he'll be the one that gets attacked. But i didn't vote for him, he didn't give me any money from his sales, he didn't check with me before he did anything... so I don't owe him anything. He did what he did for himself and he's paying the price. Everyone knows what the potential price of what he did was.
I don't say he deserves to be in prison because of my careful legal analysis or some deep insight i have into the process or obscenity law, religious affiliation or for anything else. I have only said he deserves to be in prison because he is the one,who by choice, positioned himself as the prime candidate to be the example set by the DOJ. When the jury can't watch the evidence because they are so repulsed by what they see... then there is a problem.
A simple fact about "Max Hardcore" is that even the vast majority of pornographers refuse to defend him, his content or his alleged "rights".. much less, the public at large.
