There is money being made off of prisons and prisoners, at the cost of the tax payers, but it is not the reason there are so many people in jail.
There are so many people in jail because our legal system is political device. Many judges and most DA's in this country are elected. During election years you hear about prosecutions and you hear various other politicians brag about how "tough on crime" they are. These people all want to be elected and one of the best ways to do that is to convince the voters you will put people in jail. So when you then get elected you have to do exactly what you have said you will do or you won't get elected again. This is one of the reasons we have the death penalty. People want to know bad guys are being put in jail, it helps them sleep well at night, and these politicians are simply giving the people what they want.
That there are people making money off of it is just a byproduct of the political system.
