You did need his permission whether you agree with it or not. It is as simple as that.

So, it appears you even agreed to his terms.
Intellectual rights are pretty cut and dry on this situation, whether you like it or not.
Unless otherwise specifically stated the creator (not the conceiver) owns the rights.
