Shoehorn posted a great example from Blockbuster to show that HE KNOWS affiliate programs don't need (or allow) affiliates to bid on their established brand and domain.

Actually, if you don't have clear terms, then technically you are responsible for paying on any sales that don't violate US law. Carding and cookie stuffing are two completely different animals, one being illegal and the other not.
Any attorney would tell you the same thing.
I recommend you consult with one ASAP and rewrite your TOS..
