Carding is by the law illegal no use to put that in your TOS.
Stop being a idiot, he at least sends the PPC to you, I never would have done that. I always send it to the competitor.

Shoehorn posted a great example from Blockbuster to show that HE KNOWS affiliate programs don't need (or allow) affiliates to bid on their established brand and domain.
