at this point, both sides are in a losing scenario and since you asked i will give you an honest answer.

personally, i would sue.. its the dumbest thing to do giving money to the lawyers, but once someone started threatening my business whether i was right or wrong in the first place, i have to defend what is mine.

however, i am stubborn to the point of being stupid so i wouldnt recommend what i just typed..

maybe what one solution would be is to have shoehorn paid, the thread deleted and everyone moves on and its dropped..
