Actually trademark owners LEGALLY HAVE to protect their copyright, or else they lose it.

They have to be seen to be actively protecting it.

In this case, it seems very very simple.

It wasn't in the Tos. Pay the man.

If it was in the ToS, it would be different.

Is the ToS updated yet?
