You do understand the difference, right?
Dirty D didn't change his TOS, he didn't send a letter, instead he kept taking the traffic and affiliate sells from his affiliate, keeping the money for himself.
Almost everyone agrees that if Dirty D wants to change his TOS, and notify his affiliates about the change, and that he won't pay "future" sells of that sort, that's fine.
Plain and simple that is not what happened.
Dirty D has had ample time to make things right. Instead he has hemmed and hawed, lied and hidden.
The result is that his reputation has taken a tremendous beating, both from Shoehorn's original claim, and the numerous others which arose in large part because Dirty D thought he could cruise away from taking any public responsibility for his actions.
