DENVER - A man accused of trying to rob a marijuana dispensary in an incident where a woman jumped on his back and wrestled him to the ground was formally charged on Wednesday.
James Leyva, 21, faces charges of attempted first-degree murder, attempted aggravated robbery, second-degree assault and possession of a weapon by a previous offender.
Prosecutors say Leyva went into The Healthy Choice in Denver last week with two other people. Their guns were drawn as they tried to rob the medical marijuana dispensary.
Melissa Hernandez, the owner's sister, told 9NEWS she leapt onto Leyva's back and refused to let go, wrestling him to the ground. A scuffle ensued, shots were fired, and 22-year-old Martin Martinez and 29-year-old Rene Frias apparently got away.
Leyva is in the Denver County Jail on a $150,000 bond. He will appear in court on Monday afternoon.
