Yep going after the end user is not a solution, they need to target ISPs. I think they should impose kinda "know your client" policy for ISPs worldwide, like they did with the banks. Under such a policy ISPs will still have their safe harbor, but only when they know the real name and address of their client and can hand it over to either law enoforcement or to the copyright holder for future court case, if this client was caught uploading infringing materials (this goes for both free and paid service providers). If the infringing client could not be found, ISP is responsible (3 strikes or whatever the exact procedure will be, doesn't matter).
