If by protection you mean how our legal system currently works in the U.S. and Canada and many Countries... then yes, anyone can use this - just most people don't need it. It's a registered name you publish for a set amount of time, and a couple other minor fees to pay.
Bit easier in some countries than others.. but either way, it's about as complicated as, getting out of your chair.

Regardless of the law, $2000 is nothing worth even contacting a lawyer over. It'll cost more to just have them review it and draft something up. It's something for small claims court at best.
And even if it was defamation, do you really think Nysus has a ton of money sitting in accounts? That's not a knock on him, it's just you don't sue someone with no money for defamation unless it's some high profile media situation. It'll cost much more to do so than he'd ever get with winning. And defamation cases are extremely hard to win for a number of reasons. You typically have to show malicious intent and in my opinion, Nysus truly believes he has been ripped off.
