While your contractor is responsible for ALL the work done it sucks for him when one of his subs does substandard work. Sounds like the sub didn't know or care how to install the flashing which it's purpose is to keep water from seeping in.
The real culprit is the sub contractor and the one that should get the most blame. The faulty flashing is not something your contractor would notice and really the only way he would is by either watching them as they install it or when it fails like yours did.
Because of that I wouldn't put ALL the blame on your contractor and make his life miserable before he burns in hell. You had a two year warranty and it made it past that.
Since lots of other home owners are having the same problem you can probably work out something with the builder and take them to court if you have to. Be civil about it and try to understand it's not ALL the contractors fault and he's already miserable at this point
