Well...the federal government can and does...as the Supreme Court determines what laws that Congress enacts are constitutional or not. Over the years State rights have been slowly but surely infringed upon due to Congress and Supreme Court decisions. Thus the States may or may not win...what will ultimately be decided by the Supreme Court.
