You can't patent or trademark an idea -- stuff like that falls under "trade secrets" in the intellectual property realm. Ideally, you need a nondisclosure agreement (NDA) with hefty liquidated damages.

That being said, any real player will be leery of signing such an agreement. In this industry, you really need to bring more to the table than just an idea.
