Like most legislation enacted in response to newspaper headlines (i.e. the OJ case), it ain't exactly the wisest law ever written.
It's my understanding that in most states an arrest is only made if there's evidence of a physical confrontation. Otherwise, the man is merely shown the door until such time as he, her, or both of them have sobered up.
