If this was the order of operations then Barefootsies prevented himself from being scammed by using the PayPal dispute system as it was intended.
I've used the dispute system before in a similar manner... I had paid for an item off of Ebay which was defective and I couldn't get the seller to contact me back. When the dispute period was about to be up I had no choice but to file it. After I did the seller contacted me back (finally) and he exchanged the item for a new one. I guarantee if I would have let that period pass me by I never would have seen a working product
