Just a suggestion...
Why not just ask them to be a vivid cash affiliate when you contact them? Give them that option first, as opposed to just sending a DMCA or threatening them and forcing them to remove the content? You might gain some decent traffic and sales. You can always threaten them or DMCA them a few days later.
