So, several days on the webmaster has not responded to my DMCA notice.
I reported them to their Dutch service provider and also to VBuletin for breaching their terms and conditions of use. So far I have heard nothing back from anyone though :-(
To piss me off even further today I have discovered that another well known file sharing forum is making things much more difficult than before. Following a message to the webmaster I received the message back:
"For some time now **** has offered and managed a complimentary blacklist. This service has been discontinued from 03 May, 2010
Provisions for takedown and copyright infringement are precisely dictated by the Digital Millennium Copyright Act (DMCA) and safe harbor requirements of section 512 - a full copy of the Act may be found using google.com
The old blacklist gave the impression of an undertaking by saff.cc to monitor content 24/7/365. Nothing in the statute imposes affirmative obligations for **** to watch for or block potential future infringements save removal of clickable/url content found on **** and compliant with a properly filed DMCA notice.
**** operates in compliance with this act and as such, variations applied by **** in the past by offering a complimentary blacklist fall outside the scope of the Digital Millennium Copyright Act (DMCA) and safe harbor requirements of section 512.
This left us legally exposed and we are taking this opportunity to confirm our documented procedures for the expeditious removal of your content, within the scope of the Digital Millennium Copyright Act (DMCA) and in a professional manner.
We assure you that properly filed Notices of claimed infringement will continue to be acted on expeditiously by ****
Please file your infringement claim in accordance with our takedown procedures, the following link outlines our DMCA Policy and provides an on-site url for the information required to expedite your claim. ****/index.php?action=forbidden"
At least they are responding, but still...what the fuck?
Why is it getting more difficult for producers to protect their copyrighted interests?
I have tried to star out all refence to the offending website so I can't be accused of giving 'free advertsing' to them!
