They didn't come out with a new regulation, they added to regulations they already had. "Every Merchant Account" has a privacy clause in it that says you can't share the billing data with anyone, without consent, lots were doing it though.... then every developed Country has laws on this too.

3rd party processors don't circumvent this... if anything they enforce extreme policies on cross sales and retain total control over them at all aspects. They retain the billing data 100%, if it's a client or a cross sale to another client. They also have very enforced limits and automatically shut xsales down if you hit those limits.
