What makes the difference is... Did the ORIGINAL site lose money from the usage... And in cases of Cam Chat sites, NO! In fact, those sites increase their profits with more promotion of hot girls on their site... This is why sites that offer affiliate programs USE images of girls in the banners, iFrames, etc.
I agree that the definition needs to be more clear though! But the deciding factor in court and with juries is 'Did the original owner lose money from it?'... Usually answer is no. It is why cases of Copyright Infringement never see court time unless it is in the thousands of dollars... Some petty guy with a home computer, usually just get threatened to remove the content via scare tactics and warning of lawsuit. They usually remove it in fear BEFORE any proceedings take place.
