There is basically two possible scenarios here:

1) Derek swiped a chip from sorta-drunk Carlos' hand.

2) Drunk Carlos was in a good mood, drinking, partying, winning - he gave the chip to Derek

If it's #1, Derek could himself have been very drunk and while that's no excuse, it's an explanation. It happens. If he then spent the money, or really did forget about it and left for his flight home then when he spoke to Carlos, he should have just apologized, saying he was drunk and he'll send him back his money.

If it's #2, firstly, he shouldn't have accepted it. If he did and spent it, when Carlos contacted him, he should have told Carlos that he was drunk and gave it to him. If that was the story, Carlos should just have accepted it at that - or, Derek could have offered him back half the money so they each take the loss.

The fact Derek gave him $350 at a later date would almost instantly signal guilt; but knowing Derek, he seems the type to always want to avoid confrontation, so it's not too far-fetched to believe he may have paid him that hoping to just put the issue behind them.

Thats sums things up, but in the end it doesn't matter which case it is, what's with promising payments on certain dates and not delivering ? If you can't afford it, just tell him so; if you think you don't owe him it, you also should have said so.
