I was in Vegas at that time, unfortunately not present at that incident. if it is correct that Carlos has pushed the chip at Derek and refused to take it back, then his drunken ass should have cost him $500 - no doubt. We all make stupid mistakes when being drunk that cost a lot of money sometimes, i could list a few of mine as well (it mostly revolves around strip clubs). And I know Quagmire and have no reason to believe he makes stuff up.
From my point of view it just looks a little different: no matter how the chip changed ownership, Derek had agreed to return the money. Which would be very generous if Carlos really refused to take it back in his drunken stupor.
But now we have a completely new situation - now we have someone who promised over the course of 2 years payment multiple times and never kept his word. Who wanted to make a payment plan for $150 and did not keep another promised payment of $50 on the 16th. And this is from my point of view not acceptable.
But never in this process, at least not to my knowledge, Derek has indicated that he thought that this money was given to him as present and that he thought that he could keep it. If that would have been thrown into discussion, I probably would have suggested a 50/50 and everyone get over it.
But promising payment and not keeping the promises is what got me annoyed.
I hope that cleares that up.
