I am not a lawyer but my understanding is that it becomes illegal if the underage person is displayed in a sexual gratuitous manner or engaged in sexually explicit activities. That is why it is legal (although morally objectionable) for nude art sites to have minors in the nude. I could not imagine such a site with an affiliate program though. I would hope they would edit out anyone under the age of 18
