Yes you can be penalised if your site is spammed all over the net. Yes you can lose rank or be wiped out completely by other people.

The only way of getting around this is by having enough legitimate links to justify your position. When I said hardlinks before I meant on spam sites, or sites that have recently turned spam.

I'm sure we'll see all the hates selling their SEO techniques in 'Buy and Sell' soon anyway.
