No...they are not really going after them.
In answer your second question.
I personally am not aware of any wins in court...the ones I am aware of have been thrown out of court. Their are a couple of active court cases that have yet to be determined.
In answer to your third and fourth question.
The biggest change I have seen in affiliate programs is more hosted gallaries...more embeds...more videos...more content available. In the next five years there will be fewer and fewer affiliate programs.
