If the site removes the content after a DMCA notice they lose. The fight against piracy is much wider than the porn industry, so maybe there will be changes in the law. That said it will not stop Tubes taking customers away. Some sponsors will give the Tubes all the content they need or actually own major Tubes sites.

Very little has changed. The PPS model was hit when VISA changed it's rules and that hit a few sponsors and affiliates.

No it's not dead or dying. A few will still make some money. The days of big money for many are over. Depending on what you call big money. 7-8 figure yearly incomes.
