you need to stop listening to specific lawyers that want to make money with you, you need to talk to law firms that have a real clue about this subject. If anyone has told you that suing tube surfers that do not upload infringing content would work, you should quickly get a new law firm, since they do obviously not care for you or the industry, just for their own pockets.
Trust me, I have spent so much money on both sides of the fence and now own the biggest production company and the biggest tube, that I obviously got VERY educated on the subject and not by some random law firm, but by a major anti-piracy law firm which has won some of the biggest cases.
I have absolutely no problem with you suing torrent trackers, torrent uploaders, pornbb type boards and all their surfers and similar obvious infringers. BUT downloaders of torrents that are not obviously infringing is a huge issue in my book. Suing tube surfers that did not upload infringing content, is just a hilariously stupid thing to even mention in this context since it is something COMPLETELY DIFFERENT even compared to torrents.
Suing infringing tube sites that do not comply with DMCA, absolutely no issue again.
DMCA exists for a reason, for a bigger one that most of the people here realize.
