Basically... Kazaa was controlled software, that searched and recorded the search, across the p2p network, matching people up directly to other users... and you could lbrowse through what they had, I think that was an issue too.
Torrent, (not the trackers) isn't a single controlled software, it doesn't record anything and it does not control access/accounts, the torrent-user isn't searching 'you' then grabbing a variety of things.
Now the trackers, are some what like Kazza, other than the bit differences and search doesn't gather/log anything. I think that is why some of the torrent sites/trackers have taken the heat and not the technology directly.
