I spoke to my own attorney about this. He said they can remove anything if a user violated their TOS because it is a TOS violation and has nothing to do with DMCA. It is not a DMCA issue. That is why you have a TOS in the first place, to list YOUR rules. His example was Youtube.
Problem is, Nathan knows if they start removing the 1000s and 1000s of videos their uploaders put up there, their tubes would be done in a matter of a few weeks, and they can't do that. So.... more BS about they won't say anything and it's back to business, as usual, as expected. Nothing has changed.
Based on them banning a user if he has multiple violations, I personally could remove over 5000 videos if they deleted their uploads as well. Imagine how fast they would crumble if everyone went at them?
