Actually don't you mean that they aren't setting the one particular cookie commonly associated with your normal affiliate program? From what I recently saw they were setting cookies without clicks, just not the same one used by most affiliates. Splitting hairs but could be significant depending on what your system does with all those cookies. You should consider clearly detailing this somewhere. I'm not saying you're doing this but only that it is possible. Couldn't you in theory design the system to give the popunder cookies priority over the normal affiliate cookies? Thus it would be good to state affirmatively that this is not being done. Absent such a statement from your company any assumptions that you are not doing this is just that -- an assumption. Just because it isn't the same cookie does not necessarily mean it isn't significant as far as how credit for sales is allocated depending on how your software is coded.
