Why? They are policing their content and hurting the thief where it hurts most... the wallet.
If every single person that downloaded or streamed a jacked porn movie on the internet was always worried that they would get slapped with a lawsuit with the ability to settle out for say a few hundred bucks (as well as spare themselves the humiliation), they would think twice about doing it again.
Especially if it happens two or three times. At that point, maybe they might just figure it's not worth it and actually buy a membership.
