Maybe he is, maybe he isn't - there may be other merchandise using the logo - posters, t-shirts, etc. The telecast bio/stats they often use to highlight a player may contain the logo as well.

It really doesn't matter. You must defend your trademark or risk losing control of it. The next guys to use it could claim they weren't copying your logo, but that of this player. I'm not saying you have to be a dick or anything, but get some kind of contract specifying how the logo can be used and what recompense you're getting for that particular usage.

On a side note: If I gave away pimproll content for free wouldn't you attempt to sue me?
