Sure you do. If someone steals your car and you didn't know it, and then they use that car in a crime, your not guilty of anything other than having your car stolen - which is not a crime.
If someone piggybacks your wireless and uploads a virus that takes down a large percentage of computers, you've done nothing wrong other than being stupid and not locking down your wireless connection. And with most people not having any idea how the Internet works, this is most likely common. I know that at any given time with my laptops I can log in from one of half a dozen unsecure wireless networks in my development here.
