Wow, the back and forth is entertaining. It's good to know about these 90 day contracts. I may have to try that in my shooting in the future. And just out of curiosity, who exactly do you enforce that against if it gets breached? A model that got paid $1K or $2K at most and has it blown by weeks end and probably has all manner of financial issues that would make enforcement and penalization pretty much impossible anyway?
If a model shoots with another photographer, there's no way to get back the content that has been captured, the only recourse would be to go after the model and threaten the shit out of them, which seems the logical assumption in this case if it is in fact a contractual thing. Could possibly be something else obviously.
You couldn't go after another photographer in any case as the restriction would be between you and the model and honestly....... going after a model for breach of contract? Sounds threatening, but who wants to spend $300 in a filing fee for something that would get settled out of court anyway. It's like going after a housefly with a bazooka. The cost/reward is just silly.
I'm surprised anyone could convince a model to take the level of cash we pay girls and restrict them for 90 days (maybe for $10K, sure, but for $1K or $2K??? and yeah, we all know how much everyone offers, but how much they really pay is completely different). I may have to work on my charm and see what I can get these girls to do when they don't know any better!
