The ICM registry itself announced a process by which trademark owners can prevent their trademarks from being registered as .xxx domains.
The ICM registry thereby acknowledged that trademark infringement is a possibility or even a threat.
The fact that the ICM Registry charges $200 or $300 (per domain) to prevent these violations from taking place could be used against them.
