That's definitely not good news.
Didn't hear about this one. I guess being out of the loop by not living in LA is sometimes a good thing.
I'm not sure why there is this conspiracy of silence among some in the industry, or why people would cover-up for some of the most lame-brained stupidity imaginable. Will it take a performer dying from a drug overdose on a set for people to out bozos that honestly seem to have little business in this industry in the first place?.
As for the scenario that you outlined, I would venture to say that a case might be made that there was a
chain of negligence which contributed to what happened, particularly if it can be proven that the hiring studio did not properly train/supervise the Director they hired to shoot their scene.
And it could be worse. For example, in a case like this one involving Manwin, they might look at whether the studio bothered to certify whether the Director that they hired had current liability insurance, permits, etc. If not, well, you can see where that might lead.
Likewise, if a CEO / Managing Partner is publicly cracking jokes about creating and watching blooper videos of people being injured on their porn sets, well, that kind of callous disregard for people employed for their production just might not play too well in front of a jury either, but as Fabian likes to tell people, what do I, or anyone, besides himself, know?
