WHAT DID THE PRODUCER DO WRONG?
Nothing that I can see, even from the model?s complaint, that caused this accident. However, according to the model he promised to get her medical attention following the shoot. Having made that promise he should have done that, it would have cost $100 or less at the nearest urgent care center. He could have added it to the invoice. Follow through on your promise, just like you expect from someone making a promise to you.
IS THIS A WORKERS COMPENSATION CLAIM?
Models are traditionally considered independent contractors in this industry, but CAL OSHA has made clear they consider them employees. So the producer may have an exposure to workers compensation claim plus penalties, but even if he wins the issue that she is an independent contractor he incurs crippling legal fees. He should have followed through with the promised medical attention and insisted even if she declined.
WHERE ARE THE PHOTOS?
Here she is surrounded by photographers and there is no decent photo of the injury. Where is the photo of the scar? Maybe it can?t be seen.
DAMAGES?
Here is where the rubber meets the road.
Porn model gets a tiny burn resulting in a tiny scar to her ankle and claims she can?t work and needs laser therapy and skin grafts to return her to her all natural look. The suggested claim here is that the scar will detract from her appearance causing her to loose work. The scar, whatever it?s appearance, is located at the most distant part of the body from the focus of her adult modeling ? her face and her pussy. The truth is the ankle will not even be in the photos and video where her pussy and/or face are featured, and is in all likelihood covered by a pair of platform shoes anyhow. But, that ugly tattoo of a bug located on her abdomen close to the pussy, is OK? I would take the scar, no matter how ugly, over the tattoo any day. Maybe she should forget the ankle and concentrate on that stupid tattoo.
I am wondering why she can?t work because of a tiny scar on her ankle? If she gets a settlement I?m taking bets she gets more tattoos.
BOTTOM LINE:
PRODUCER made a promise and should have followed through with it. Just treat her the way you would like to be treated and you are likely to be in good shape. The model finished the shoot, you should have given her the medical treatment you promised.
MODEL can?t expect to retire on an inconsequential injury, go visit a burn center and with your renewed appreciation of your good fortune from that experience go back to work, with a smile on your face.
BRAZZERS isn?t responsible for anything here, but under the ?deep pockets? concept you are probably facing some expense defending yourself so figure out a way to get the best PR from it.

Now THAT seems the most sensible post of this whole thread...
