It's been "proven" many times in other scenarios. A guy at a stoplight was waiting for it to turn green, as another car turning the corner slammed into him. The cop writes a ticket for reckless driving that later got dismissed. Why? The guy at the stoplight had a suspended license. Meaning, if the stoplight guy did not break the law driving, the other guy could not of hit him.

Are you totally fucking high? A crime is a crime. The two women committed a crime. The man committed a crime. Not a real tough concept to grasp. One crime does not justify another crime. You could use your logic to say that if it didn't rain in Bejing on December 4th, 1986... the women wouldn't have been born and then entered McDonalds and no one would have then committed a crime... so they all should go free.
