First, you are making assumptions. Second, it's irrelevant from a legal standpoint what one might assume. It's about what a jury believes is a reasonable assumption, the presence of a threat and the severity of that threat and a proportionate response. You can always argue that had i not killed the guy, he would have gone home, got a gun and killed me. That doesn't make it ok to beat a guy to death because he throws something at you or gets in your face or takes a swing at you.
I swear man, you guys are not children, but you think and act like children. Whats so hard to understand? You can't continue beating someone when they are down? That's not a new concept. Knocking someone down thats coming at you and trying to hurt you for example, can be self defense... picking up a weapon, following them to the ground and continuing to beat on them with that weapon is felony assault.
Not a brand new concept invented yesterday... pretty much the same in all 50 states and in most of the world.
