the whole reason there is a private park there is because they traded it to the city to bypass zoning for $$$
in a nutshell
a company says " hey city , can i build a huge building here ? "
city says " no , wrong zoning"
company says " ill give you half the property and build a park on it for the public"
city says " ok "
so if owner kicks people out , they void the contract and would have to demolish pricey highrise that violates zoning
