You can't take it down and if they choose to send you free traffic they have to be another of the "rogue affiliates" we hear so much about.

This situation is a clear indication of why the laws need to be a lot tougher than they are today. No one but he and people at VS know what's happening here. Who owns Intporn.com and where are they and if sued through the courts will it be like trying to grab mist?
What ever that's a long process. Much better to lodge a complaint that shows them to be pirates and crash the site. These guys that run Intporn can't even be bothered to take down a banner on their site.
Why screw around, shut them down and if they want to appeal, let them turn up in court. Because clearly they are not responsible enough to remove a banner, getting them to adhere to loose laws like copyright and DMCA is a joke.
Also dragging in advertisers and making them culpable to damages will make them a lot more cautious about who they allow to promote them.
Or do you think irresponsible people like these should have the responsibility of running a site. And a powerful medium like the Internet?
Freedom has to be deserved and not abused.
