eBook selling question

I'm venturing down a different path and offering education to clients, to teach them the skills of the trade rather than charging them for services, well most of them.

Anyway, put a lot of thought into this including a business plan and its looking good, but I'm sure someone here has some experience in this area, so I figured I would ask.

First, is it safe to sell information, book seminars and offer on-site consulting as a sole proprietor? Or should I be setting up an LLC for this? I'd like to avoid any unnecessary expenses at first, but the last thing I want to have happen is some jackass tries to sue me saying I guided him wrong.

Second, is there any good DRM solution for ebooks? These are not "get rich quick" kind of books for $20 bucks a pop, but rather some lengthy details on advertising including a lot of "insider secrets." I'm trying to figure out a way to prevent selling two of these then have them flooded all over the web.

Any suggestions?
