If a com owner do not wanted to use the sunrise landrush option or talk ICM at all, he can not complain a domainer got the xxx later. Using xxx whois it is easy to see a big % of typo but also exact site names are taken by domainers (or competitors), not by program and com owners. I assume in most cases that's sort of choice of com owners.
But in addition to that, several xxx's are going in auction in January! Include some exact match of alexa #1000 , #500 pay sites, very known. I assume the domainer(s) pre-owned the org, net, biz, info or else so to triggered the auction with the com owner.
Outcome of those auctions may upset it more the com owners, as they used the sunrise landrush option and talked ICM, still did not got the XXX or had to pay it not just $100.
What I mean there is a big difference between who not wanted to get an XXX and that was got by a domainer (this is a choice of com owner... he can't complain), and who wanted to get an XXX, preonwed the com, done all ok for sunrise procedure, but for whatever reason the xxx it gone to other domainer (or competor) already or it is in auction for january and who knows how it will end.
