Yeah... I guess so.
But this sort of stuff happens all the time on big widely-used open source scripts.
HomeFree comes to mind. I think it was a 1 1/2 man coding team over the for a long time... and the guy was super slow to keep up with user requests. So the users would make their own fixes & publish them in the forums... and everyone was happy. (even though they were most likely in violation of the licensing terms)...
Eventually he would just take peoples hacks an icorporate them as base code, or give them the "seal of approval" or whatever...
Anyway I feel like I'm arguing about this a lot more than I need to now. I've made the points I wanted to make. It doesn't change the fact they used his stuff as a base to build on.
