Yea you can. There is such a thing called spirit of the law vs letter of the law.

Kids selling lemonade in their own front yard should be allowed, no questions asked. That has been going on for as long as people have been drinking sugared lemonade. However, a store/shop/restaurant in town who sells to customers on a daily basis and pays taxes on the earnings, needs a permit.

There is a huge difference between a profession and children selling lemonade or girl scout cookies.
