The state is there to protect the capitalist against the majority of the population who will form Trade Unions and freely demand ownership of what they create. The Capitalist State restricts Trade Unions, makes laws against them, makes sure the Capitalists win strikes, keeps unemployment high to lower wages, forces people to work on the threat of losing benefits.

Yes the starving worker is as "free" to enter into the transaction as the rich capitalist, if he is prepared to starve to death to prove a point.
