Regardless of where the content is located, he's publishing it. The difference between this and what The Pirate Bay are doing is that the latter only publish links to content, which people share from their home computers. Embedding is publishing the actual content for public view.

Yeah people forget that judges aren't stupid (must of the time). They know a thief when they see one. "The video itself isn't on my server" is the same as "I leave the stolen cars on the street in front of my house, not on my property. Only the keys are in my house, in my pocket. So I'm not a car thief."
I don't know anything about Boneprone's sites, but obviously if someone is ripping content that makes them a thief. "I didn't host it on my server" means squat.
(Obviously one could rip CCL licensed content, but that doesn't apply.)
