They didn't fail yet because they didn't run out of options so far - they can refile in a district that has some provable ties to xhamster, for example it could be where their cc processing or an advertising company is located. All of them do business with the US in some form or shape, and sooner or later some connection that is good enough to be admitted by court will be found.

Kink.com for example filed a lawsuit against a foreign tube DrTuber in Florida, where their DMCA agent and their billing company is located. If that will be accepted by court as a tie to Florida, that will pave the way for many other similar lawsuits against foreign tubes which will be filed in the US. It's not as hopeless as you picture it.
