I think ultimately Damian is just misstating the reality. The amount of piracy online is increasing. There is no questioning that, but I don't think it is because of litigation, I think it is in spite of it. The RIAA has settled out of court with over 30,000 plaintiffs and yet music pirating is still rampant. Sure, when something like The Pirate Bay getting blocked ends up in the news it is free publicity for the site and will give them a traffic spike, but publicity is short lived and the lasting effects of those stories likely aren't very big.

However, as time goes by people tell their friends about sites they found and those people tell other people and so on and so on and piracy grows. There are people out there who see the litigation and it makes them want to pirate more, but that is just a small segment of the population. The bigger portion are people like my nephew who has friends that tell him what sites to go do in order to download music and they tell him it is perfect legal since it wasn't them that put it up. Then he tells his girlfriend who tells her friend who tells her boyfriend and it grows.

The litigation is not causing piracy to increase. The ease of use of the technology to pirate, the ease in finding sites to pirate from and ability to do all of this from your computer with little to no risk is causing piracy to increase.
